CONSULTANCY TO ASSESS WORKPLACE CONDITIONS IN THE CONSTRUCTION SECTOR IN DAR ES SALAAM

BACKGROUND INFORMATION
TAMICO joins FIC, and together with other trade unions and youth organizations in Tanzania and Kenyain a partnership programme called ‘Decent Work and Labour Rights in East Africa.’
FIC through partnerships with trade unions in Kenya and Tanzania initiated projects aimed at developing improved employment conditions for workers with little or no education and who work under bad conditions and poor salaries. The understanding was that with efforts to strengthen the trade unions through capacity building initiatives, mutual learning and cooperation, trade unions stand greater chances to improve the conditions of work for the majority of workers.
Partnership
Tanzania Mines, Energy, Construction And Allied Workers Union (TAMICO)
Tanzania Mines Energy Construction and allied Workers union (TAMICO) is trade union belonging to the members who work in Mining, Energy, Construction industries and wood works Sectors. TAMICO is an Independent Trade union with registration no 005 of September 2000 under employment and labour relation Act no 06 of 2004. Together with other unions TAMICO Formed the national umbrella body called Trade union Congress of Tanzania (TUCTA). Currently the membership of TAMICO stands at 10595.
Objectives of TAMICOis to Mobilization and registering, protecting and Connecting all workers employed in the Mines, Energy, Construction and other related sectors works within the same Association for the purposes of enhancing their economic and social welfare, claim, defending and protecting their rights and interests.
Forum for International Cooperation (FIC)
FIC is a Danish NGO founded in 1995. Since 2006 the international development activities of FIC have been changed from primarily being focused on harbour labour to a more general focus on creating labour market inclusion for weak groups, including youth.
In East Africa the mission of FIC is to contribute to combating poverty and improving the living conditions in Kenya and Tanzania by strengthening the capacity of civil society organisations who can contribute towards creating improved employment conditions and employment opportunities for poor and vulnerable groups, including youth.
Decent Work and Labour Rights in East Africa is a programme involving five trade unions and four youth organizations in Kenya and Tanzania. The Main objectives of the programme are as below:
The development objective of the program is:
The employment conditions in Tanzania and Kenya have improved and youth have access to decent employment in line with existing national and international labour laws and regulations.
Immediate objectives
The immediate objectives of the program are:
  1. The strengthened capacity of partner trade unions in Kenya and Tanzania to advocate for and create awareness about workers’ rights and respect of labour market legislation contribute to improved working conditions.
  2. The strengthened capacity of partner youth organisations in Kenya and Tanzania to create awareness and to advocate for increased and improved job opportunities for youth has contributed to better conditions for establishing sustainable businesses and increased success in their job seeking.
TAMICO being a trade union will contribute to the immediate objective 1. The following results are expected to contribute to specific objective 1 which is related to capacity building of TAMICO:
Expected Outcome
Outcome 1: Effective engagement of employers and governments by trade unions (contribute to improved working conditions and better welfare)
Output 1.1: Target group and partners have increased capacity to address workers’ rights and health and safety issues for improved working conditions
Output 1.2: Unions have increased their capacity to recruit members and negotiate for CBAs which lead to better employment conditions at work places [1])
Output 1.3: Increased capacity and efficiency of trade unions in advocacy and lobbying for decent working conditions
1.4.1Executive committee in each union is overseeing and monitoring the implementation of the unions strategic plan and use of financial resources
1.4.2All involved unions have reviewed their internal operations and structures having in place strategic plans and structures needed to implement the plans
Output 1.5: Established governance and structures is leading to Internal transparency and accountability in trade unions involved in the program
Monitoring and evaluation of the programme
Monitoring and evaluation is considered in this programme as critical in determining the programme’s success and effectiveness. Various tools have been designed to ensure there is effective monitoring mechanisms in the implementation and the actual results at the end. One of the key outputs is the baseline studies and assessment. Baseline as an important component of monitoring is designed to explore the factors that are included in the indicators of LFA. In the context of trade unions there is a focus on the conditions at the workplace and the capacity of the unions in the baseline.
Baseline survey
A baseline survey is intended to provide comprehensive, updated and objective information on the actual situation in terms of working environment of workers in the construction sector in Dar es Salaam. The purpose of a baseline study is to provide an information base against which to monitor and assess an activity’s progress and effectiveness during implementation and after the activity is completed. The project in the partnership between TAMICO and FIC will have a very important focus on improving the working conditions of workers in the construction sector in Dar es Salaam as well as providing strategy for organizing workers in the sector especially from the private enterprises.
The Objective of the study therefore is:
  • Determine the working conditions of workers in the construction sector in Dar es Salaam; Both in relation to occupational health and safety as well as in relation to terms and conditions of employment. The assessment will include private and public enterprises in the 3 districts of Dar Es Salaam both those that have CBA with TAMICO and those that do not have.
  • Determine the size of workforce, which is not organized or which does not have union membership.
  • Do a mapping of the membership of TAMICO within the construction sector in Dar es Salaam and a profile of the members.
  • Do a mapping of all the private and public enterprises within the construction sector in Dar Es Salaam and describe the history and employment details (number and profile of the employees), numbers, activities and qualifications of branch officials in work places where they have been elected, and working conditions (CBA, contractual issues, salary, working hours, health and safety etc. of the company.
RATIONALE
Legal frameworks and enforcement of OHS policy at work places and difficulties in working with multinational companies specifically Chinese construction companies
SCOPE AND METHODOLOGY
A comprehensive study will be organized and carried out by a qualified consultant; the scope being the three Dar es Salaam districts of Kinondoni, Ilala and Temeke.
The consultant will work closely and be supervised by the two project coordinators and zonal secretary of TAMICO. It is expected that the consultant will physically visit the construction sites to have first-hand experience of the real situation. In addition interviews with the workers will be emphasized to ensure actual accounts are captured in the report. A desk review will prepare the consultant for the fieldwork.
The baseline study will involve visits to all workplaces. During the visits mapping will be conducted in cooperation with Project Coordinators and Zonal Secretary who will assist the consultant. Additionally focus group interviews will be conducted in each workplace with employees, mangers and branch officials (within the workplaces where branch officials has been elected).
The exercise will focus on two Main areas as listed below:
Working conditions:
  • The general health and safety conditions within the construction sector. Accidents reported or lack of reporting.
  • Observance and adherence to health and safety regulations within work places by the workers
  • Identify the key health and safety issues affecting workers in Construction.
  • The usage of the safety equipment by the workers
  • The conditions of machinery and equipment used by the workers
  • The employers/authorities effectiveness in enforcement of health and safety regulations and provisions of equipment and gears
Organizing and recruitment of workers
  • Determine the number of workers in the construction sectors in the three districts of Dar es Salaam City. The number that is unionized as well as those that are not unionized.
  • Establish the actual number of construction companies in Dar es Salaam, both private and public. Mapping and description of enterprise history and Main data, employment data and conditions for each company.
  • Determine the capacity of the branches to organize, ensure and monitor decent working conditions for the workers as stipulated by ILO and national laws. The structure, knowledge and mechanisms.
  • Establish the level of knowledge and understanding by the workers of their labour and constitutional rights.
  • Establish the level and knowledge of branch officials.
Output
  • Comprehensive assessment report detailing conditions of work and population of workers, their conditions of work and terms of employment and the percentage or number that is not unionized.

Consultants Qualifications
Desired Skills and Experience
· Masters degree in Labour Economics or related field and 3-5 years of relevant experience preferred.
· Coaching and training/facilitation experience.
· Organizational development and Trade union capacity building experience
· Strong organizational and interpersonal skills;
· Substantial experience in carrying out baseline survey and organizational capacity assessment
· Good experience working in trade union environment
· Strong analytical skills to critically evaluate and synthesize information gathered from multiple sources.
· Ability to exercise a high degree of discretion and confidentiality.
· Detail oriented with strong problem-solving skills.
· Conversant with labour relations issues, trade union environment and dynamics
· Industrial Relations or any other relevant field.
· Strong organizational and interpersonal skills;
· Strong analytical skills to critically evaluate and synthesize information gathered from multiple sources.
