General introduction

Under article 4.2, paragraphs (d) and (e) of the Staff Regulations, the filling of vacancies in grades D1 and D2, as well as in grade P5 for all Director positions in field offices, are made by direct selection by the Director-General.

In order to support the best informed process in the filling of the following vacancy by direct selection: Deputy Legal Adviser (D1), the ILO invites interested candidates to submit their curriculum vitae online by the above date (midnight Geneva time).

The following are eligible to apply:

INTRODUCTION
The position is located in the Office of the Legal Adviser/Office of Legal Services.

The Office of the Legal Adviser is responsible for providing legal advice and other legal services to the Organization on all matters implicating the legal interest of the Organization, including legal opinions concerning the Constitution, membership, rules and activities of the ILO. It is responsible for furthering and defending the legal interests of the Organization. All officials in the performance of their functions are expected to seek legal advice and any necessary legal services on all such matters. The Legal Adviser reports to the Director-General and directs the Office of the Legal Adviser /Office of Legal Services.

Based on the overall guidance and instructions of the Legal Adviser, the incumbent will be expected to become familiar with all aspects of the work of the Office of the Legal Adviser. He or she will replace the Legal Adviser when he is absent or not available and may be called on to provide advice on the legal aspects of delicate and complex questions of a policy nature affecting the Organization and its major organs, as well as questions of a strictly confidential nature relating to personnel, financial and other matters.

Under the general supervision of the Legal Adviser, the incumbent will be required to participate in all tasks within the competence of the Office of the Legal Adviser, as set out in Office Directive IGDS No 226 on the Office of the Legal Adviser.
Description of Duties
1.Coordinate preparation and provide amendments to the Standing Orders of the ILO organs (Conference, Governing Body, Regional Meetings, Sectorial Meetings, etc.). Provide formal or informal legal advice to these organs on problems of interpretation and application. In the absence of the Legal Adviser, may be called upon to act as representative of the Director-General at the Governing Body and Conference Committees on Standing Orders questions.

2.Assess and address questions relating to international labour Conventions and Recommendations. Examine the proposals of technical departments for new standards to determine whether they are appropriate for standard-setting action; ensure that technical departments receive advice and guidance in relation to drafting the preparatory work (questionnaires, conclusions, formal and informal instruments); represent the Office of the Legal Adviser/Office of Legal Services in the internal drafting committees and in the Committee drafting committee of the Conference on drafting and procedural questions; prepare the authentic texts; examine the validity of all ratifications and denunciations of Conventions; advise on requests for interpretation.

3.Build synergies with other intergovernmental organizations to collaborate on legal questions and developments in key areas of responsibility of the Office of the Legal Adviser/Office of Legal Services, including in relation to the elaboration and drafting of ILO standards.

4. Support the Legal Adviser in the overall supervision, monitoring and quality control of work in the following areas: preparation of pleadings which may be in English or French, advice to the Human Resources Development Department on internal procedures, interpretation, application and amendment of the Staff Regulations; advice to the financial services on issues relating to the interpretation and application of the ILO Financial Regulations and Rules; advice to the Director-General on legal aspects of pensions questions.

5. Provide direction and guidance to officials in relation to questions relating to the privileges and immunities of the Organization and its staff both in Switzerland and in Italy as regards the International Training Center of the ILO – ITCILO under the respective headquarters agreements as well as in other Member States where the ILO has offices or technical cooperation projects; the drafting and interpretation of contracts and agreements entered into the ILO of both a private and public law nature, including agreements for the execution of technical cooperation contracts.

6. Assist the Legal Adviser with the management of the human and financial resources of the Office of the Legal Adviser/Office of Legal Services, determining priorities and allocating resources for the completion and timely delivery of work products in accordance with results-based management principles. Ensure that key risks are identified, assessed and managed for the achievement of agreed results and that risk management is embedded in all core processes and functions. Assist the Legal Adviser in ensuring a harmonious working environment and helping staff members to achieve their potential.

7. Represent the Organization at high-level meetings and negotiations and in proceedings before the Administrative Tribunal.

8. Manage issues arising in other areas including in particular constitutional questions (relating for example to the Membership of the Organization) and general questions of public international law relating more particularly to the law of international organizations and the law of treaties.

9. Perform other duties as may be assigned by the Legal Adviser.

DESIRABLE PROFILE

The set of qualifications below is indicative of the type of experience, education, language skills, and competencies expected for this position.

EDUCATION
Advanced university degree in Law (doctorate or equivalent) with specialization preferably in public international law. Knowledge of labour law would be an advantage.

EXPERIENCE
At least 15 years of progressively responsible professional experience in a field relevant to labour standards, including ten years at the international level. The publication of books or articles in authoritative legal periodicals on relevant subjects would be an advantage.

LANGUAGES
Excellent command of two ILO working languages (English, French and/or Spanish).

COMPETENCIES
In addition to the ILO core competencies:

Demonstrated sound political judgment and capacity to work well in a tripartite context. Demonstrated experience and expertise in delivery of legal advice and strategic vision and leadership in carrying out the objectives and policies of the ILO.
Ability to contribute effectively as a member of the management team on organizational issues and organizational priorities and ten years of experience in managing teams
Excellent drafting, negotiation and communication skills with the ability to represent the ILO in various fora. Decision-making skills. Excellent problem-solving skills.
Strong interpersonal skills, tact, discretion, confidentiality and diplomacy.
Demonstrated ability to work effectively in teams as well as independently. Ability to work in a multicultural environment and to demonstrate gender sensitive and non–discriminatory behavior and attitudes.

Evaluation (which may include one or several written tests and a pre-interview competency-based assessment centre) and the interviews will tentatively take place between January and February 2017. APPENDIX I CONDITIONS OF EMPLOYMENT
Please note that taking effect on 1st of January 2017, the UN common system will implement a new compensation package. Therefore, the figures shown below are subject to change.

- Any appointment/extension of appointment is subject to ILO Staff Regulations and other relevant internal rules.
- The first contract will be issued for a twelve-month period (for Geneva-based positions) and a twenty-four month period (for non Geneva-based positions)
- A successful external candidate will be on probation for the first two years of assignment.
- Any extension of contract beyond the probation period is subject to satisfactory conduct and performance.

Please note that the above salary levels are determined according to the criteria established by the International Civil Service Commission. The ILO is international public sector employer and salary and other employment conditions are not negotiable.

Other allowances and benefits subject to specific terms of appointment:

Salaries and emoluments are exempt from taxation by the Swiss authorities and, on the basis of international agreements or national law relating to presence or residence abroad, are generally exempt from taxation by other governments. In the absence of exemption, in most cases tax paid will be reimbursed in accordance with an ILO document which will be supplied upon request.

While the successful candidate will be initially working in Geneva, he/she may be assigned to any duty station designated by the Director-General of the ILO.
