Established in 1951, IOM is the leading inter-governmental organization in the field of migration and works closely with governmental, intergovernmental and non-governmental partners. IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants.

Context:
The Office of Legal Affairs (LEG) provides advice and input to the Director General (DG) on all legal issues facing the Organization, and their related policy implications. LEG ensures that the functioning of the Organization is within its mandate and in accordance with international law. LEG provides legal support on all activities of the Organization, thereby contributing to the achievement of all aspects of the IOM strategy.
Under the overall guidance and supervision of the Legal Counsel and the direct supervision of the Legal Officer (LEG HR), the successful candidate will support the development and implementation of the new Staff Rules for local staff members around the world. Because the privileges and immunities granted to the Organization and its staff members vary from country-to-country, over 140 countries must be separately assessed and any “country-specific” deviations to the new Staff Rules must be identified and enumerated. This undertaking is estimated to take two years to complete.
Core Functions / Responsibilities:
  1. In close coordination with representatives of the Human Resources Management Division (HRM) and individual IOM regional and country offices, undertake a country-by-country analysis to understand (a) the extent to which privileges and immunities have been granted to IOM and its staff members; (b) the current employment terms and conditions of local staff members, including under existing local Staff Rules, if any; and (c) local labour law, to the extent it is applicable.
  2. In close coordination with representatives of HRM and resource management officers in the relevant country and regional offices, identify any acquired rights which must be protected for some or all staff members in a given country, and make appropriate recommendations to ensure respect for these rights.
  3. In close coordination with representatives of HRM, design any necessary transitional measures to be put in place in a given country and propose them for approval.
  4. Conduct research on the jurisprudence of the ILO Administrative Tribunal (ILOAT) on issues relating to the Staff Regulations and Rules, such as acquired rights, in order to ensure that the rollout of the new Staff Rules to local staff members is done in a manner consistent with the law of the international civil service.
  5. Provide legal advice on administrative issuances (Official Instructions) to be developed or revised in connection with the new Staff Rules.
  6. Provide legal advice on personnel-related documentation, such as designation of beneficiary forms and templates for employment contracts and official communications related to appointment and separation from service.
  7. Perform such other duties as may be assigned.

Technical

  • Adapts best human resources practices to the requirements of IOM to facilitate the achievement of strategic objectives;
  • Anticipates and understands internal and external issues and opportunities that may impact the human resources landscape of IOM.
Required Qualifications and Experience
Education
  • Master’s degree (or higher) in law from an accredited academic institution with five years of relevant professional experience; or
  • University degree in the above field with seven years of relevant professional experience.
Experience
  • Professional legal experience required;
  • Professional experience must include at least one year of practicing law in an intergovernmental organization providing legal advice on human resources matters;
  • The following additional experience will be an advantage: (a) developed research skills and knowledge of the ILOAT or UNAT/UNDT jurisprudence;
    (b) knowledge of the staff conditions of service under the IOM system or UN common system; (c) experience with privileges and immunities of an intergovernmental organization and its staff as they relate to terms and conditions of employment.
Languages
Fluency in English is required. Working knowledge of Spanish and/or French is an advantage.
